Minutes of Meeting
On April 29, 2010 the Dublin Zoning Board of Adjustment met at the Town Hall for its regularly scheduled monthly meeting. Those present were:

Also present was Tara Germond, newly elected member of the Planning Board.
The meeting was called to order at 7:00 p.m. by Chairman Cavanaugh who presented a written agenda for the meeting.
Discussion on Special Exception Approval for Peter Galbraith Map 8, Lot 3A-A
Peter Galbraith was present asking for a Special Exception to Article IX, Section B2 of the Dublin Land Use Regulations in order to replace an existing (1969) manufactured home with a new, larger manufactured home on property located at 7 Pine Acres Lane, Town of Dublin Map 8, Lot3A-A in the Rural District. Mr. Galbraith explained that he has a buyer for the property, but they would like to be sure before they buy the property that it will be acceptable to replace the present manufactured home with a larger one. The present square footage of the home is 981.6 and a proposed new one would be 1904 square feet.
Joe read the notice on the public hearing from the April 22nd Monadnock Ledger Transcript and then asked Peter Galbraith to explain how his application satisfies the conditions for a Special Exception in the Town’s Land Use Regulations.
- Criteria #1: The lot does not conform to the current lot size requirements in the Rural District. However, the existing manufactured home is grandfathered since it was installed on the lot several years before the 4-acre lot size requirement went into effect in the Rural District
The board expressed concern over whether the new manufactured home satisfied the Town’s lot line setback requirements. Mr. Galbraith said he had paced off the land and felt it more than satisfied the 35-foot setback requirement. Mr. Galbraith also said he had not measured it precisely.
- Criteria #2: The lot appears to be an appropriate location for the proposed use. Mr. Galbraith talked about the sand/gravel soil and good drainage at the site. Mary Liz said there didn’t appear to be any wetland, topography, or soil issues at the site. Jim expressed concern that the buyer might not remove the existing manufactured home when he installed a new one at the site. Mr. Galbraith said he would not object to a requirement to remove the old home as a condition of approval. Susan then asked about the septic system. Mr. Galbraith said the existing and new home both had three bedrooms. There did not appear to be much information available on the septic system except that there was not record of failure. The Board said the septic system would have to be replaced if it failed.
c) Criteria #3: The proposed change would not adversely affect the value or character of the adjacent properties. In fact, the values may increase after the new manufactured home is installed. No abutters attended the hearing and so it appears they have no objections to the proposed change.
- Criteria #4: The lot conforms to the requirements in the Land Use Regulations. Mr. Galbraith stated there was 200 feet of frontage on Route 137 and 300 feet on Pine Acres Lane. The Board advised that the frontage on Pine Acres Lane satisfies the Town’s 250-foot frontage requirement.
- Criteria #5: No hazardous waste is to be handled on the property. Mr. Galbraith said that the only hazardous waste that could be generated is roof shingles, but they would be put into a dumpster and hauled away from the site.
- Criteria #6: The traffic from the site should not increase after the proposed change.
- Criteria #7 & #9 The application was very simple and straight forward and so the Board waived the requirements for a Site Plan Review and requests for comment from the Planning Board, Conservation Commission and Health Officer.
Joe closed the public hearing and the Board deliberated on the application.
After deliberation, Jim moved that a Special Exception be granted to Peter Galbraith (Executor to the estate of Darlene Taylor) to install a new manufactured home at 7 Pine Acres Land (Map 8, Lot 3A-A), Dublin, subject to the existing manufactured home being removed from the site before the new one is installed. The footprint of the new manufactured home can be no more than 50 percent (%) greater than the original home’s footprint. Dan seconded the motion and the Board approved the motion 5 to 0.

The minutes were reviewed. Susan moved the minutes be approved, seconded by Dan. Motion approved.
Potential Changes to the Land Use Regulations
Discussions were continued from the March 4th and 25th meetings regarding potential changes to the Land Use Regulations. The meeting focused mainly on the need for good, up-to-date mapping; bringing the Land Use Regulations more in line with the Land Use Goals and Land Use Initiatives from the 2007 Master Plan; and updating the Table of Uses. It was decided that the next step was for Joe to meet and solicit input from the Chairmen of the Planning Board, Conservation Commission, and Open Space Committee and report to the Board on the results at the next meeting.
